Certain business and personal transactions are neither oral nor written but are nevertheless legally binding.  The terms of these agreements are understood from the cations or conduct of the parties, from the customs of the trade, or from the conditions or circumstances rather than from oral or written words.  Do you think implied contracts should be enforceable? Why or why not?

do think that implied contracts should be enforceable if both (or more)
parties have a mutual understanding on what they each want. Implied
contracts are also something that people do everyday without maybe
even knowing it. If someone were ordering food at a restaurant, it would
go without saying from the server that they’d have to pay afterwards.
Although, it could be difficult to prove that there was an implied contract
because people are not explicitly stating it. However, if the actions of
both parties make it to where it’s inferred that an implied contract is in
place, then it should absolutely be enforceable.
